Here's a more detailed breakdown: Ownership and Volume: The copy of record confirms who owns the water share and specifies the volume of water allocated to it, typically measured in megaliters. Water System and Reliability: It details the specific water system your water share is linked to (e.g., river, dam) and its reliability, indicating how consistently you can expect to receive your allocated water. Encumbrances: The document also reveals any registered interests or restrictions on your water share, such as mortgages or limited-term transfers. Trading and Transfers: If you plan to trade or transfer your water share, the copy of record is essential for verifying the details and ensuring a smooth transaction. Legal and Regulatory Compliance: It serves as evidence of your water entitlement for various legal, regulatory, and planning requirements related to water management and usage. You have made a deal with someone you know to see water or shares but need some help with the paperwork. Water Partners can help out but producing and lodging the paperwork or even holding the funds in trust until it is settled.

A mortgage discharge on water shares in Victoria involves formally releasing a water share from a recorded mortgage. This is usually done after the mortgage has been paid off. The process involves lodging a "Discharge of Mortgage of Water Share" form with the Water Registrar at Land Use Victoria. Here's a more detailed explanation: 1. When is a Discharge Needed? A discharge is needed when a mortgage on a water share has been fully repaid, whether through a loan payoff, refinancing, or other means. It ensures the water share is no longer subject to the mortgage and any associated obligations. It may also be required before transferring or granting a limited-term transfer of the water share. 2. How to Discharge a Mortgage on a Water Share: Obtain the Form: The "Discharge of Mortgage of Water Share" form can be found on the Water Register website. Complete the Form: The form must be completed accurately and legibly, using blue or black ink, according to Land.Vic. Lodge the Form: The completed form, along with any necessary supporting documents (like mortgagee consent if not discharging the entire mortgage), should be lodged with the Water Registrar at Land Use Victoria. Fees: There are fees associated with lodging the discharge, but it may be free if lodged by a certain date, as was the case for discharges lodged before December 31, 2009, according to servictoria.com.au. 3. Supporting Documents: Mortgagee Consent: If the discharge doesn't apply to the entire water share or is not a full discharge, consent from the mortgagee (the lender) will be needed, according to Land.Vic. Notification Form (W-19WA): If discharging a mortgage on only part of a Water Access Licence (WAL), a Notification form W-19WA subdividing the WAL may also need to be lodged. 4. Importance of Lodging: Lodging the discharge ensures the mortgage is officially removed from the water share's record. It protects the water share owner's rights and interests by removing any encumbrances associated with the mortgage. 5. Who Can Help? Solicitors or Conveyancers: They can assist with the discharge process, ensuring all requirements are met and the paperwork is handled correctly.
